1. About CookPalAI

CookPalAI is an AI-powered mobile cooking assistant that helps users discover recipes, plan meals, improve culinary skills, and interact with an intelligent chef assistant. The Service is provided by Andrei's Miracle Software S.R.L., a company registered in Romania.

Our Service includes, but is not limited to:

• AI-powered cooking chat and recipe recommendations
• Personalized meal planning based on dietary preferences and health goals
• User-generated content such as recipes, reviews, and cooking tips
• Subscription-based premium features under the 'Cook Pal Pro' plan
• Integrations with third-party services for enhanced functionality

2. Eligibility and Account Registration

2.1 Eligibility

The Service is intended for users who are 16 years of age or older. If you are under 16, or under the minimum age required in your jurisdiction, you may only use the Service with the explicit consent and supervision of a parent or legal guardian. By using the Service, you represent that you meet this age requirement.

We do not knowingly collect data from children under 13. If we become aware that a user under 13 is using the Service without verifiable parental consent, we will terminate the account and delete associated data.

2.2 Account Creation

To access the full features of CookPalAI, you must create an account using a valid email address or a supported third-party sign-in (such as Apple ID or Google). You agree to:

• Provide accurate, truthful, and complete registration information
• Keep your credentials secure and confidential
• Notify us immediately of any unauthorized access at support@andreismiraclesoftware.org
• Not create multiple accounts, share, transfer, or sell your account
• Be solely responsible for all activity occurring under your account

We reserve the right to suspend or terminate accounts that violate these Terms, contain fraudulent information, or have been inactive for an extended period.

3. Subscriptions and Billing

3.1 Subscription Plans

CookPalAI offers premium subscription plans, including Cook Pal Portion on a Monthly or Cook Pal Full Dish on a Yearly basis. Subscription pricing is displayed within the app at the time of purchase and may vary by region. All subscriptions are purchased directly through the CookPalAI mobile application. We reserve the right to introduce, modify, or discontinue subscription plans or pricing at any time, with reasonable advance notice to existing subscribers.

3.2 In-App Purchases and Payment

All subscriptions and purchases are made exclusively through the CookPalAI app. Payment is charged to your selected payment method at the time you confirm your purchase within the app. All transactions are processed securely through RevenueCat, our third-party payment processor. Andrei's Miracle Software S.R.L. does not directly store your payment card or financial details. By completing a purchase, you authorize the applicable charge to your payment method and agree to RevenueCat's terms of service. In the event of a billing dispute, we ask that you contact us first at support@andreismiraclesoftware.org before initiating a chargeback with your payment provider.

3.3 Free Trial

From time to time, Andrei's Miracle Software S.R.L. may offer a free trial period for Cook Pal Pro at its sole and absolute discretion. Whether a free trial is offered, its duration, its eligibility criteria, and any conditions attached to it are determined entirely by us and may be changed or withdrawn at any time without notice. A free trial is a privilege, not a right, and we reserve the right to limit free trials to one per user account. Unless you cancel before the free trial period ends, your subscription will automatically convert to the applicable paid plan and your payment method will be charged at the standard rate. We are under no obligation to offer a free trial to any user at any time.

3.4 Auto-Renewal

IMPORTANT: All Cook Pal Pro subscriptions automatically renew at the end of each billing period (monthly or yearly, as applicable) unless you cancel before the renewal date. Your payment method on file will be charged at the then-current subscription rate upon each renewal. It is your responsibility to cancel in advance if you do not wish to be charged for the next billing period.

3.5 How to Cancel

You may cancel your subscription at any time directly within the CookPalAI app. To cancel:

• Open CookPalAI and go to your Profile page
• Tap Subscription > Manage Subscription
• Select Cancel Subscription and confirm

Cancellation takes effect at the end of the current billing period. You will retain full access to Cook Pal Pro features until that date. No refunds are issued for any remaining unused portion of the subscription term.

3.6 No Refunds and In-App Voucher Policy

ALL PAYMENTS MADE FOR COOK PAL AI SUBSCRIPTIONS ARE FINAL AND NON-REFUNDABLE. By completing a purchase, you acknowledge and agree that you are not entitled to a refund, credit, or reimbursement of any subscription fee, whether for a full or partial billing period, for any reason, including but not limited to: cancellation before the end of a billing cycle, dissatisfaction with the Service, change of mind, failure to use the Service, or any other circumstance.

In-App Voucher Credit (Goodwill Gesture): Notwithstanding the above, Andrei's Miracle Software S.R.L. reserves the right, entirely at its sole and absolute discretion, to issue an in-app voucher or service credit as a goodwill gesture in exceptional circumstances. Any such voucher is non-transferable, has no cash value, cannot be exchanged for a monetary refund, and is valid for a period of time determined solely by us at the time of issuance. The issuance of a voucher in any one case does not create an obligation or precedent to issue vouchers in any other case. To inquire about a goodwill voucher, contact us at support@andreismiraclesoftware.org. All decisions regarding voucher eligibility and duration are final.

Payment Processing: All subscription payments are processed securely through RevenueCat, our third-party payment processor. Andrei's Miracle Software S.R.L. does not directly store your payment card details. By subscribing, you agree to RevenueCat's terms of service and authorize the applicable charge to your selected payment method. In the event of a billing dispute, please contact us first at support@andreismiraclesoftware.org before initiating a chargeback with your payment provider.

Note for EU/UK Users: If you are located in the European Union or United Kingdom, you may have a statutory right of withdrawal of up to 14 days from the date of purchase. However, by confirming your purchase and accessing the Service immediately, you expressly request that performance of the Service begins before the end of the withdrawal period and acknowledge that you will lose your right of withdrawal once the Service has been fully performed. Where the Service has not been fully performed, a proportional refund may apply. Nothing in this refund policy excludes or limits any rights you have under mandatory EU/UK consumer protection law.

Note for Australian Users: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law.

Note for all users: Nothing in this refund policy limits any other statutory rights you may have under mandatory consumer protection law in your jurisdiction that cannot be contractually excluded under applicable law.

4. AI Processing and Third-Party Providers

CookPalAI uses artificial intelligence (AI) to power its core features including recipe recommendations, conversational cooking assistance, and personalized suggestions.

4.1 AI-Powered Features

When you interact with the CookPalAI chat assistant or use AI-powered features, your messages, inputs, and associated context (such as dietary preferences or cooking history) are transmitted to and processed by third-party AI backend providers. These providers operate under strict data processing agreements with us and are bound by confidentiality and security obligations.

By using the AI features, you acknowledge and consent to your inputs being processed by these third-party AI systems to generate responses. We do not sell your data to AI providers, and your data is used solely to deliver the Service.

4.2 AI Output Disclaimer

AI-generated content — including recipes, nutritional information, ingredient substitutions, and cooking advice — is provided for informational purposes only. It may contain errors, omissions, or inaccuracies. CookPalAI does not constitute professional dietary, medical, or nutritional advice. Users with health conditions, allergies, or specific dietary needs should consult a qualified professional before relying on AI-generated recommendations.

You agree not to rely solely on CookPalAI outputs for decisions that affect your health or safety.

4.3 Other Third-Party Services

We integrate with the following categories of third-party services:

• Analytics providers (to understand usage patterns and improve the Service)
• Cloud infrastructure providers (to host and operate the Service)
• Subscription and billing processors (Apple App Store / RevenueCat)
• Crash reporting and performance monitoring tools

These providers access only the data necessary to perform their function and are contractually prohibited from using your data for any other purpose.

5. User Content

5.1 Your Content

CookPalAI allows users to submit, post, or share content such as recipes, reviews, photos, comments, and cooking tips ('User Content'). You retain ownership of all User Content you create. By submitting User Content, you grant Andrei's Miracle Software S.R.L. a worldwide, royalty-free, non-exclusive, sublicensable license to use, host, store, display, reproduce, and distribute your User Content solely to operate, improve, and promote the Service.

5.2 Content Standards

You agree that all User Content you submit will comply with these Terms and applicable law. You must not submit content that:

• Is hateful, discriminatory, defamatory, abusive, or offensive based on race, gender, religion, nationality, disability, sexual orientation, or any other characteristic
• Is pornographic, obscene, or sexually explicit
• Promotes, incites, or glorifies violence, terrorism, or extremist ideology
• Exploits, harms, or attempts to harm minors in any way
• Infringes any intellectual property rights, privacy rights, or other legal rights
• Contains false, misleading, or fraudulent information
• Impersonates any person or entity
• Contains malware, viruses, or other harmful code
• Violates any applicable law or regulation

5.3 Content Moderation

We reserve the right (but not the obligation) to review, moderate, edit, or remove any User Content at our sole discretion, without notice, for any reason including content that violates these Terms. We may use automated systems and human reviewers for this purpose.

6. Acceptable Use

You agree to use CookPalAI only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

• Use the Service to generate, distribute, or publish illegal content
• Attempt to access, probe, or test the vulnerability of our systems
• Use automated tools, bots, scrapers, or scripts to extract data from the Service
• Reverse engineer, decompile, or attempt to extract our source code or AI models
• Use the Service to develop competing products or services without our written permission
• Circumvent any security measures, access controls, or usage limitations
• Engage in any form of fraud, phishing, or identity theft through the Service
• Interfere with or disrupt the integrity or performance of the Service
• Harass, threaten, or harm other users
• Use the Service in jurisdictions where it is prohibited by law

Violation of acceptable use policies may result in immediate termination of your account and, where applicable, referral to law enforcement authorities.

7. Intellectual Property

7.1 Our IP

All rights, title, and interest in and to CookPalAI — including its software, design, branding, logo, trademarks, AI models, content, and underlying technology — are owned exclusively by Andrei's Miracle Software S.R.L. or its licensors. Nothing in these Terms grants you any rights to use our intellectual property except as explicitly permitted.

7.2 Your Inputs and AI Outputs

You retain ownership of any inputs you submit to the Service. Subject to compliance with these Terms, any AI-generated outputs produced in response to your inputs are assigned to you. However, similar outputs may be generated for other users submitting similar inputs, and we make no exclusivity guarantee over AI outputs.

You may not use AI outputs to train competing AI models, claim false authorship, or misrepresent content as entirely human-created when it is AI-generated.

8. Privacy and Data Protection

Our collection and use of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using CookPalAI, you consent to our data practices as described in the Privacy Policy.

• We collect name, email, usage data, location (approximate), health/dietary information, and subscription data
• We use third-party AI providers to process your chat inputs
• We comply with GDPR (EU/UK), Romanian data protection law, and applicable global privacy regulations
• You have rights to access, correct, delete, and port your data

9. Cooking Safety, Health, and Injury Disclaimer

IMPORTANT — PLEASE READ CAREFULLY: CookPalAI provides recipes, cooking instructions, nutritional information, ingredient suggestions, and culinary guidance generated by artificial intelligence. Cooking inherently involves risks including, but not limited to, burns, cuts, fire hazards, equipment injuries, foodborne illness, and allergic reactions. BY USING THE SERVICE, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

• YOU COOK AT YOUR OWN RISK. Andrei's Miracle Software S.R.L. is not responsible for any personal injury, bodily harm, death, property damage, foodborne illness, allergic reaction, or any other harm or loss of any kind arising from or related to your use of CookPalAI's recipes, instructions, suggestions, or any other content generated by the Service.
• AI-GENERATED CONTENT IS NOT PROFESSIONAL ADVICE. Recipes and cooking guidance provided by CookPalAI are generated by artificial intelligence and may contain errors, omissions, unsafe ingredient combinations, inaccurate cooking times or temperatures, or information that is unsuitable for your specific circumstances. This content does not constitute professional culinary, nutritional, medical, or dietary advice.
• ALLERGIES AND DIETARY RESTRICTIONS ARE YOUR RESPONSIBILITY. You are solely responsible for verifying that all recipes, ingredients, and suggestions are safe for you and anyone you are cooking for, including checking for allergens, intolerances, and medical dietary restrictions. CookPalAI does not guarantee the accuracy or completeness of allergen or nutritional information. Always verify ingredients independently, especially if you or someone you are cooking for has a known allergy, intolerance, or medical condition.
• USE YOUR OWN JUDGMENT. Cooking safely requires personal judgment, skill, and awareness of your environment. You are solely responsible for ensuring that you follow appropriate food safety standards, use kitchen equipment correctly, and apply safe cooking practices at all times. CookPalAI is a tool to assist and inspire — it is not a substitute for your own common sense, care, and competence in the kitchen.
• CHILDREN AND VULNERABLE INDIVIDUALS. If you are cooking with or for children, elderly persons, pregnant women, immunocompromised individuals, or anyone with special dietary or health needs, you bear full responsibility for ensuring the suitability and safety of any recipe or instruction before use.
• NO LIABILITY FOR HARM. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANDREI'S MIRACLE SOFTWARE S.R.L., ITS DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INJURY, ILLNESS, DEATH, PROPERTY DAMAGE, OR OTHER HARM ARISING OUT OF OR RELATED TO ANY RECIPE, COOKING INSTRUCTION, NUTRITIONAL INFORMATION, OR ANY OTHER CONTENT PROVIDED BY COOK PAL AI, WHETHER CAUSED BY NEGLIGENCE, AI ERROR, OR OTHERWISE.

Nothing in this section limits any statutory consumer rights that cannot be excluded or limited under mandatory applicable law in your jurisdiction.

10. Disclaimers and Limitation of Liability

10.1 No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

Nothing in these Terms limits any consumer rights that cannot be excluded under applicable mandatory law.

10.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ANDREI'S MIRACLE SOFTWARE S.R.L. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total aggregate liability to you for any claims arising from your use of the Service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) EUR 100.

10.3 Indemnification

You agree to indemnify, defend, and hold harmless Andrei's Miracle Software S.R.L. and its officers, directors, employees, and agents from any claims, liabilities, damages, and costs (including reasonable legal fees) arising from: (a) your violation of these Terms; (b) your User Content; (c) your violation of any applicable law; or (d) your intentional misconduct or fraud.

11. Export Controls and Sanctions

You represent that you are not located in, or a resident of, any country subject to comprehensive trade sanctions under applicable export control laws. You agree not to export, re-export, or transfer access to the Service in violation of applicable export control or sanctions laws. It is your sole responsibility to ensure your use of the Service complies with all such regulations.

12. Termination

We may suspend or permanently terminate your access to CookPalAI at any time, with or without notice, if we determine that you have violated these Terms, engaged in fraudulent or unlawful behavior, or for any other reason at our discretion.

You may terminate your account at any time by deleting it through the app settings or by contacting support@andreismiraclesoftware.org. Upon termination, your right to use the Service ceases immediately. Clauses relating to IP, disclaimers, limitation of liability, indemnification, and governing law survive termination.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Romania, without regard to conflict of laws principles. For EU users, mandatory consumer protection rights under your country of residence also apply.

Any dispute arising out of or in connection with these Terms shall first be submitted to good-faith negotiations. If unresolved within 30 days, disputes may be referred to the competent courts of Romania, or to the applicable consumer dispute resolution body in your jurisdiction.

EU users may also access the European Commission's Online Dispute Resolution platform at: ec.europa.eu/consumers/odr

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the 'Effective Date' at the top of this document and, where required, through in-app notifications or email. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

If you do not agree to the revised Terms, you must stop using the Service and may cancel your subscription via your Profile page in the app.

15. Miscellaneous

• Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.
• Waiver: Our failure to enforce any right does not constitute a waiver of that right.
• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Andrei's Miracle Software S.R.L. regarding the Service.
• Language: These Terms are provided in English. In case of conflict between translations, the English version prevails.
• Assignment: You may not assign your rights under these Terms without our consent. We may freely assign our rights.

16. Apple App Store — Additional Terms

If you downloaded CookPalAI from the Apple App Store, the following additional terms apply. These terms are required by Apple and take precedence over any conflicting provisions in these Terms solely to the extent necessary to comply with Apple's requirements.

16.1 Acknowledgement

You acknowledge that these Terms are concluded between you and Andrei's Miracle Software S.R.L. only, and not with Apple. Andrei's Miracle Software S.R.L., not Apple, is solely responsible for CookPalAI and its content. These Terms may not provide for usage rules that conflict with the Apple Media Services Terms and Conditions.

16.2 Scope of License

The license granted to you for CookPalAI is a limited, non-transferable license to use the application on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. This license may also be accessed by other accounts associated with you via Family Sharing or volume purchasing, where applicable.

16.3 Maintenance and Support

Andrei's Miracle Software S.R.L. is solely responsible for providing maintenance and support services for CookPalAI, as specified in these Terms or as required by applicable law. You acknowledge that Apple has no obligation whatsoever to provide any maintenance or support services with respect to CookPalAI.

16.4 Warranty

Andrei's Miracle Software S.R.L. is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed in these Terms. In the event of any failure of CookPalAI to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price for the application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to CookPalAI. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the sole responsibility of Andrei's Miracle Software S.R.L.

16.5 Product Claims

You acknowledge that Andrei's Miracle Software S.R.L., not Apple, is responsible for addressing any claims by you or any third party relating to CookPalAI or your possession and use of CookPalAI, including: (i) product liability claims; (ii) any claim that CookPalAI fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

16.6 Intellectual Property Rights

You acknowledge that, in the event of any third-party claim that CookPalAI or your possession and use of CookPalAI infringes a third party's intellectual property rights, Andrei's Miracle Software S.R.L., not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such intellectual property infringement claim.

16.7 Legal Compliance

You represent and warrant that: (i) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

16.8 Third-Party Terms

When using CookPalAI, you must comply with all applicable third-party terms of service. This includes, but is not limited to, your wireless data service agreement if you access the Service via a mobile network.

16.9 Third-Party Beneficiary

You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
